The Decline of the Paternal Function in the Modern Family

Abstract
This paper analyzes the historical decline of paternal authority within the family institution and its transformations within the Argentine socio-cultural and legal framework, contrasting them with psychoanalytic perspectives. Through a historical review, it examines the evolution of patria potestas from the absolute power of the paterfamilias in Roman Law to successive legislative reforms in Argentina, highlighting the creation of the Patronato de la Infancia, the equalization of women's civil rights, and the enactment of Law 23.264 establishing joint parental authority. Furthermore, it addresses modern family dynamics in light of women entering the workforce, capitalist demands, and advances in reproductive medicine, concluding that the filial bond is structured through desire and symbolic order rather than strictly biological ties. Finally, drawing from the theories of Freud and Lacan, the article demystifies the figure of the omnipotent father to conceptualize the paternal function as a symbolic articulation regulating desire and the law within culture.
